Copyright items blatantly for sale

Nobody is vetted Carol, Folksy don’t vet any shops before they open and then rely on other sellers to report shops that we think should not be allowed on Folksy. I’m not doing anymore as it takes up my time that I need for my business.

Well thank goodness there are still honest people who care about these things. It’s easy enough to check up and ask on folksy, plenty of knowledgeable people to help.. it does make me angry though especially regarding toys. As you said people assume it’s okay because it’s for sale on here. Let’s hope the rules change to prevent any harm :+1:

Regarding the picture of the dress above, what’s the point of reporting a shop if nothing is done?

PS and if we dare to mention it on here we get chastised and nasty messages about against the rules… but I think i have made it as clear as i could that I am not calling out… that’s up to anyone else to work out what i am referring to. :slight_smile:

And I just wanted to say. Just imagine if all the new shops were as gorgeous as this one which has just appeared. :

and it isn’t breaking any of the rules of what is allowed to be sold…
Just imagine what a wonderful customer experience it coule be, for anyone visiting Folksy to see only shops like this . Benefits each and every one of us to whereas…copyright infringements, drop shipped from India, assembled, non tested toys…

With regards to IP infringement you are better to report them to the IP owner as it is only the owner that can file a take down notice.

Indeed but the site can remove them before that becomes necessary as it gives such a dreadful overall look to a sales platform.

I believe the sites should perhaps be better at policing the site and asking the seller for their licensing documentation if a report is made from someone other than the IP owner, however the sites say it is the responsibility of the IP owner to protect their IP and that is how they don’t have to do anything unless a formal take down is issued.

Just to add another little thing - it should be clear whether a fabric is licenced when you buy it. If I have any doubts, I always check with the fabric seller and if it is, avoid it like the plague! Different title holders are diligent and aggressive about their titles to varying degrees - Disney, Marvel and the likes of Sanrio (Hello Kitty) are very assertive.

From what I’ve learned over the years, there are also lots of little rinky dinks like, for example, fabric featuring Pooh Bear is always going to be licenced, unless he isn’t wearing the little Disney jumper - that wasn’t part of the original art work and therefore naked Pooh is public domain :bear: :honey_pot:

I’m sure I also reported the seller who imports Indian made clothing when I spotted them in the best sellers list a few weeks ago. Handmade the garments may be but by people working for peanuts in a factory…not at all what I want to be seen alongside.

Regarding the dresses, there also seems to be a discrepancy regarding the material. I know I would personally be annoyed if I purchased something purporting to be cotton, only to find out it’s anything but.

It is my understanding that when the new legislation kicks in that the main selling platform, (Folksy) is just as responsible for what is being sold on it’s platform and it’s contents offered for sale conform to u.k. legislation; copyright infringement being one of them.

Folksy can be held just as responsible as any independent shop seller in the case of any harm caused. For example, if a soft bear purchased via a Folksy shop doesn’t conform to safety standards and a child chokes on an eye which came away Folksy will be held just as responsible as the seller under the new legislation if they didn’t do the checks or remove the item from the sellers shop. The seller must have safety certification for any item which may be classified as a child’s toy and purchased as such by Jo Bloggs . If an item clearly states on a listing not suitable for children under a certain age or this item is not a toy then Folksy would not be held responsible for any harm caused. It’s Folksy’s responsibility to check sellers have the appropriate safely certifications in future. If my understanding is correct I can’t wait for the new legislation to come into force. I think a lot of dodgy shops will disappear and Folksy will have to start vetting their sellers prior to selling with them.

Here is an example of 100% British Handmade. Not from anywhere at all in India, Asia and not even any materials or tools sourced there either.
I can prove my handmade credentials. . :winking_face_with_tongue:

After I saw @Folksyhq instagram post clearly stating that “every item on Folksy is made by the person selling it”. The shop in question clearly states this is not the case. I didn’t get any response

Sadly at this rate Folksy will be losing genuine handmaker sellers making in the UK and ending up as EBay without the reach. It is getting worse. Remember when I joined years ago far more professional than it is now, being let down big time.
People coming here to buy will wonder what has happened with bought in items, made in other countries. The clothes need to go I do not care if they have had sales or not. Not handmade in the UK.

Surely that post you saw is a breach of trading standards as false information.

That’s what worried me, as they were clearly stating something that wasn’t true, and it was my main reason for bringing it to their attention. They’ve asked us to direct any concerns to them directly rather than in the forum, which it seems alot of us have without any action or response

I have been reporting for more time than I care to think about. Spending ages checking new shops, searching, finding things on Temu and Ali. Report sometimes the shops are taken down but others not with no rhyme nor reason.
