Weāve had a little cake party for my daughterās birthday this morning (too early if you asked me). Sheās turning 5 on Monday but my mum is flying home tomorrow so we wanted celebrate with her.

Just wanting to pick your brains. Iām thinking of making some ādecorate your own decorationsā kits - with blank clay decorations, some little paint pots and brushes. Do I need to comply to any regulations, as this is classed as a toy isnāt it? And Iāve read some things about selling toys and was wondering if I need to fill in any forms or anything. Canāt find forms on the gov website but found a page with UKCA labels you can download. If anyone knows a link to something if I do need it thatād be great.

that reminds me of my childhood⦠@TownAbout ā¦my dad worked within walking distance of St Paulās and my mum actually took me up to the top ( above the dome and through the famous whispering gallery)ā¦I can still remember it wellā¦and looking out from my dadās office window watching the Lord Mayorās parade.
Has anyone else been up there?.
Brenda @teabreaks I have been up several times and tried out the whispering gallery - it works. Never made it up the Monument though as my little brother got scared part way up and we had to come down.

Hi Judy @judyrowleyart, my understanding is if the finished item isnāt a toy or a thing that a child plays with, and the kit has an element of skill learning, it may be a learning kit and not need specific toy testing, adding the UKCA/CE mark, and completion of the full legal document of conformance.
However, what is a learning kit is not that precise, as the resource Kirsty has already shared indicates. For example, things like jewelry kits for kids do need toy testing, but painting decoration kits donāt.
But as the image above says, even if it doesnāt need specific toy testing, the kit will still need to be risk assessed under General Product Safety Regulations, and appropriate tests done or mitigating actions taken to ensure they are safe for any age to use. For example even for kits targeted only at adults, we wouldnāt use ādodgy paint we bought onlineā as we donāt know what chemicals are in it. In your case, if the paints, brushes etc are UKCA (CE marked) or from a reputable arts supplier you could reasonably assume they are safe to include. Not sure about the blanks - if you make them yourself you can do your own assessment based on the ingredients. You just need to record your risk assessment (in case you are ever asked by Trading Standards, or a safety issue arises), and make any necessary warnings such as āsmall partsā on the label.
There are also 2 really good Facebook Groups - one linked to the resource above and another that is just for soft toys. Both are a good place to get advice for anyone making toys, or not sure if their product is a toy/has play value. For info, the legal cut off for a child under the regulations is age 14 - the regulations are not just for babies and toddlers.
