New GSPR EU regulations - Northern Ireland shipping

Thank you @folksycontent that’s really helpful.

Totally agree with you Carrie👍 after 13th Dec I won’t be selling within NI, my own region of the UK, because NI is to be included with EU as a shipping region and can’t be separated out. Understandable in order to meet the regs, but such a shame I think. I’ve never sold to EU before this and it’s not my intention to start, but heigh ho there you go! At least I can continue to sell to GB, channel islands and IOM as normal.

My mohairs are Helmbold and Steiff, both come from Germany, the prices have shot up since brexit and I wouldn’t be surprised if they don’t continue to climb, at which point i will have to hang up my bear making tools and retire. I have just spent £300 and not a lot to show for it, some that were around £100 p/m are now at least £150, the high end ones are not even affordable now. My bears are having to increase a lot but there’s no profit, will see what next year brings. I use to buy in metre pieces, my latest order was mostly quarters. I found an old price list that I typed up about 6 years ago to use for costings, the prices have more than doubled.

He he I’m glad Folksy havent made the change yet. Just had an order from NI.
I have added a note to my acknowledgement email thanking them for order today and warning that after 13 th they won’t be able to order from me. I will post it today and tracked 24 it should be there tomorrow. .

BUT What if they had ordered something which is made to order and takes 2 weeks to ship ???

Hi Joy

NI…at the moment is it just the same as shipping within the uk or do EU regs apply, I know the new regs come in on 13th.

Hi Debby I’m pretty sure that the regulations that come in on 13th apply from that date and before that normal conditions apply for NI. I’ve been busy getting my own purchases in from other Folksy sellers as was worried no one would be selling to here anymore. I’ve received them here in NI no problem over this weekend. I would say regs apply on 13th and not before then.

I think you’d still have been OK Joy, you’d placed it on the market before 13 Dec and that seems to be what counts, not the delivery date

Will have to do that too. Such a shame as they are in the UK.

Can you really inagine the people faced with the nightmare of checking the regulations are being followed will be checking placed on market dates… Nope they will check the date the parcel was posted and go from there.

I’m going to stick a warning on my social media to buy now and before the 12th… I can always do private sales if stopped on here by then.

Yes but you’d have an order date to prove you’d sold it before the 13th so you’d be fine

Thank you Jean.

This must be a nightmare situation for yourself and other sellers in NI, I can understand the rest of the EU but with NI being part of the UK I thought it may have been different for trading within the UK …I hope it doesn’t have too much of a negative effect in your business Jean

Thanks Debby for your kind words. One effect for me will be my sales here within NI. Because NI can’t be separated from EU as a shipping region, in order to comply with the regs. I don’t currently sell to the EU and have no plans to. So I can’t sell to customers in my own region of the UK as things stand. No solution atm but Folksy have told me this will be looked at in 2025. Happy to say I can still sell as normal to my folksy customers in GB, Channel Islands and IoM.

All of this has me wondering what the rules are if a person in the UK sends a parcel containing a gift to a person in the EU, you know, like a birthday present, which wouldn’t have an invoice or anything else included that would make it look like a commercial transaction…

Deleting that. Don’t want the thought police after me :rofl::rofl::rofl:

Ah right thank you Jean for explaining, I didn’t understand how it worked for yourself in NI but I’m really pleased to hear you can still sell to GB. Crazy isn’t it when you can’t sell to people in your own region but happy to hear Folksy will be looking into it next year.

I don’t think things work like that, not in the real world.
Sadly for my customer relations I think that by the time the issue was resolved the customer would have given up all hope of receiving the lovely piece/s they had ordered from me, probably for Christmas gifts and would have given me a 1 star Google review. And undoubtedly the beautiful lovingly made piece/s of glass would be found in 3 years time down the back of a cabinet in whatever office the Gspr officials do their work.

Interesting reading

New Rules for E-commerce Platforms

With a booming online marketplace, the GPSR places new responsibilities on digital platforms and other e-commerce operators. These platforms must ensure that products offered by third-party sellers adhere to EU safety standards, particularly when items come from non-EU manufacturers. This marks a significant change, as online marketplaces will be more accountable for monitoring and acting against potentially unsafe products. It is a move designed to protect consumers but one that will likely increase compliance costs for these platforms.

This also mentions that the UK is exempt with selling within the UK at the moment! Watch this space.

One good thing to come out if this means all toys etc will have to be tested and carry full details. Would plug a hole.

As far as I read Jean, the info in the folksy guidance mentioned above says that you can be your own representative as you live in N. Ireland. ?

Hi Janet thanks  yes NI folky sellers can be their own representative for selling in the EU if they wish to do so. The issue is NI is having to be removed from the UK and put with the EU in the Folksy shipping options. For NI Folksy sellers who don’t ship to the EU and who sell within the UK only, there is currently no option to choose NI and exclude the EU. It also means charging EU rates for postage even though NI is part of the UK. Folksy have told me at present there is no solution to this, but that they will be continuing work to look at shipping options for us all in 2025.
