Wondering if someone could help please. I’ve checked Folksy for items using The Very Hungry Caterpillar fabric and found some items for sale. But, I’m not sure whether I can use the panel, create something and then sell in my shop? The fabric panel states, that it’s right protected. Does this mean I shouldn’t use it? I did ask Angie from Finger Picking Good, but just notice she is taking a break. I thought I’d seen comments on licenced fabrics not to be used. Sorry for the long story, but thanks for feedback. From my understanding any fabric that is licensed it cannot be used to make anything for sale. There has however been an article recently in the US that stated the fabric could be used to make something to sell as by buying it you have bought the right to use. Personally I would check and double check before you do.

Checked and yes, indeed as this is protected then I can’t sell. However, I did send an email last week. So will wait to see what I hear back.

US copyright laws are different to UK.
I am aware of that Diane spent 13 years working in law. However a lot of licensed fabrics are made in the US.
Hungry caterpillar is made by Andover a US company and distributed by Makower UK.
The laws are the same re copyright and an ocean will not make any difference to suing for use of fabric as Disney have proved in recent years. A case was brought within the UK for using fabric to make items to sell, Disney won.

If the fabric is marked as “not for commercial use” then it means just that, you can’t use it. If it is ANY licensed or branded fabric at all, you can make items to sell but you cannot used any trademarked terms to sell it (this includes all brands). If the actual image is trademarked (often in the case of Disney images) then you also cannot use if to sell products.

I was just pointing out that it isn’t just licensed fabric that the law applies to as well the actual intricacies of the law with regard to trademark usage, just in case anyone comes across this thread in the future when looking for advice.
